What is Maine PFML?

Maine PFML is a new state-administered wage-replacement program operated by the Maine Department of Labor. For the birth, adoption, or foster placement of a new child, it provides up to 12 weeks of partial wage replacement per benefit year, with benefits starting May 1, 2026.

The program is funded by joint employee + employer payroll contributions, which began January 1, 2025. Official rules at maine.gov/paidleave.

Who is eligible for Maine PFML in 2026?

  • You have worked for a Maine employer in covered employment
  • You earned at least $7,188 in Maine during your base period, the first four of the last five completed calendar quarters before leave starts
  • Your leave begins on or after May 1, 2026

Self-employed individuals can opt in voluntarily. Some employers may use approved private plans in lieu of the state program.

How much will you receive each week?

Maine uses a two-tier bend formula:

  • 90% of your average weekly wage up to 50% of the State Average Weekly Wage
  • 66% of your average weekly wage above that
  • Maximum weekly benefit: $1,249.12, which is the SAWW itself

The SAWW resets every July 1, not January 1. It was $1,198.84 through June 30, 2026 and is $1,249.12 from July 1, 2026 through June 30, 2027. If your benefit year starts after next July 1, expect a different cap.

Over a 12-week leave at the cap, that is about $14,989. Solidly mid-pack among state programs: more than New Jersey and New York, less than California, Washington, or Oregon.

How long can you take Maine PFML?

  • Up to 12 weeks per benefit year, combined across every leave reason. This is the single most misread rule in the program. Bonding, your own medical recovery, caring for a family member, and military exigency all draw on the same 12 weeks. Eight weeks of medical recovery leaves four for bonding, not twelve.

When can you file your Maine PFML claim?

For leaves beginning on or after May 1, 2026, file your claim before leave begins or as soon after as possible.

Maine PFML is wage replacement, but is your job protected?

Job protection in Maine comes from:

  • Federal FMLA: 50+ employees, 12 months service, 1,250 hours
