Quick answers
Eight questions most parents ask about this program. Full detail below.
- Who qualifies for maternity leave in Maryland?
- Nobody yet. Maryland FAMLI has been delayed three years running, and benefits now begin January 3, 2028, with payroll contributions starting January 1, 2027. When it does start, eligibility is 680 hours worked in Maryland over the prior 12 months, which is lower than federal FMLA's 1,250 hours. Until then Maryland has no state wage replacement for parental leave.
- How much does maternity leave pay in Maryland?
- Up to $1,000 per week as the statute is currently written, indexed after the first year. Treat that as provisional: two more years of delay is ample time for the legislature to revise it, and Maryland has amended this law repeatedly. We re-check it every month.
- How long is maternity leave in Maryland?
- 12 weeks in an application year for all reasons combined. You can reach 24 only in the specific case where you qualify for both bonding leave and your own serious health condition in the same application year. Most parents will be planning around 12, not 24.
- Does FMLA cover maternity leave in Maryland?
- Until 2028, federal FMLA is the whole story in Maryland: 12 weeks of unpaid, job-protected leave at employers with 50+ employees, after 12 months and 1,250 hours. Job protection is not income. FMLA guarantees your job is there, not that you get paid.
- Does short-term disability cover maternity leave in Maryland?
- Maryland has no state disability program, so short-term disability through your employer is the only realistic wage replacement for a birth in 2026 or 2027. Typically 6 weeks after a vaginal birth or 8 after a cesarean, at 60% to 70% of pay. If your employer offers it, this is the single most important benefit to confirm.
- Can both parents take parental leave in Maryland?
- Not yet, since there is no program to use. From 2028 each parent will have their own 12-week entitlement. For a birth before then, the practical question is whose employer has the better parental leave policy and short-term disability plan.
- What mistakes do parents make with maternity leave in Maryland?
- The big one is planning around a launch date that moved. Maryland announced, then delayed, then delayed again, and plenty of guidance still online says July 2026 or even 2025. Contributions do not start until January 2027 and benefits not until January 2028. Anyone telling you Maryland has paid family leave right now is working from stale information.
- How does Parental Leave Pro help?
- For a Maryland birth before 2028 we map what actually exists: federal FMLA, your employer's parental leave policy, short-term disability, and PTO, sequenced so you are not stacking unpaid weeks by accident. We also flag when FAMLI contributions and benefits begin so you know whether a second child might qualify.
Maryland FAMLI 2026: what arrives in 2028, and what covers you until then

What is Maryland FAMLI?
Maryland FAMLI is a new state-administered wage-replacement program operated by the Maryland Department of Labor. For the birth, adoption, or foster placement of a new child, it provides up to 12 weeks of partial wage replacement per benefit year, with benefits starting January 2028 (benefits).
Contributions to the program began earlier (at the rate set by the FAMLI Board) and are joint employee + employer. Official rules at labor.maryland.gov/employment/famli.
Who is eligible for Maryland FAMLI in 2026?
- You have worked at least 680 hours in Maryland during the qualifying period (about $3,000+ in wages, depending on rate)
- Your wages have had FAMLI contributions withheld (most W-2 employees in Maryland)
- Your leave begins on or after January 2028 (benefits) (the program start date)
Self-employed individuals can opt in voluntarily. Owner-employees paid through W-2 payroll are treated like W-2 employees, as long as FAMLI contributions are being withheld.
Note: Some employers may have elected to use an approved private plan in lieu of the state FAMLI program. Confirm with HR.
How much will you receive each week?
Maryland uses a tiered bend formula:
- 90% of your average weekly wage up to 65% of the State Average Weekly Wage
- 50% of your average weekly wage above that
- Maximum weekly benefit for 2026: $1,000 (statutory cap, indexed in future years)
Examples for 2026:
| Your weekly wage | Approximate weekly benefit |
|---|---|
| $500 | $450 (90%) |
| $975 (65% of SAWW) | $878 |
| $1,200 | $990 |
| $1,500 | $1,000 (cap) |
| $2,500 | $1,000 (cap) |
Over a 12-week bonding leave at the cap, that is $12,000 in benefits.
How long can you take Maryland FAMLI?
- Up to 12 weeks of paid bonding leave per benefit year
When can you file your Maryland FAMLI claim?
For leaves beginning on or after January 2028 (benefits), file your claim before leave begins or as soon after as possible. The Maryland Department of Labor will publish the application process well before the July launch.
Maryland FAMLI is wage replacement, but is your job protected?
Job protection in Maryland comes from:
- Federal FMLA: 50+ employees, 12 months service, 1,250 hours
- Maryland Parental Leave Act: applies to employers with 15-49 employees not covered by federal FMLA; provides 6 weeks of job-protected parental leave
- Maryland FAMLI Act: job-protection provisions apply to FAMLI-covered workers
Coordinating FAMLI with employer policy
Stacked. Employer policy pays in addition to FAMLI.
Supplemental. Employer tops up FAMLI to a target percentage of full wages.
Offset. Employer pays the policy minus what FAMLI pays.
Key HR questions:
- "Has the company elected an approved private FAMLI plan?"
- "How will our paid parental leave coordinate with Maryland FAMLI starting January 2028 (benefits)?"
The HR email every Maryland parent should send
Subject: Parental leave planning. Questions for HR (Maryland FAMLI starts January 2028 (benefits))
Hi HR team,
I am planning for a parental leave that will begin after January 2028 (benefits), and want to confirm:
- Are Maryland FAMLI contributions being withheld from my paycheck?
- Has the company elected an approved private plan?
- What does our parental leave policy provide?
- Is the policy stacked, supplemental, or offset with respect to FAMLI?
- Will my health insurance continue during leave?
- What is my reinstatement position?
Thank you.

Common Maryland FAMLI mistakes to avoid
- Filing for leave that begins before January 2028 (benefits). Benefits are not available until that date. Plan around the launch date if possible.
- Not knowing whether your employer uses a private plan. Private plans must offer at least equivalent benefits but the filing process differs.
- Confusing Maryland FAMLI with the Maryland Parental Leave Act. FAMLI is money. MPLA is job protection at smaller employers.
- Missing tenure requirements. Some Maryland job-protection laws have tenure or hours-worked tests.

Questions Maryland parents ask most often
My baby is due in June 2026. Am I covered by FAMLI? Benefits start January 2028 (benefits). If your leave begins before that date, you would not receive FAMLI benefits for the pre-July period. Plan around this with HR.
Can both parents take FAMLI for the same child? Yes. Each parent can independently take up to 12 weeks.
My employer uses a private plan. Are my benefits the same? They must be at least equivalent to FAMLI. Check specific terms with HR.
Can I take FAMLI intermittently? Yes, with proper certification and employer agreement.
